RENT

Rent is due the 1st day of each month, and will be considered late if not paid by the 6th of the month. Beginning the 7th, tenants will be charged a $25 per day late fee.  If rent is not paid by the 10th of the month, access to the building/rehearsal space will be terminated, and TSRS, will assume ownership of all property in the room to cover the cost of rent, fees, and reletting. Payments will be accepted online through our website www.topsecretrehearsal.com. 

TSRS may increase the monthly rent at or after the expiration of the original term of this lease by providing the tenant with written notice at least 30 days prior to the next rent due date. The Tenant then has the option to vacate the premises or to remain at the new rental rate.

Tenants on a monthly or longer agreement agree to give 30 days notice of intent to vacate.

SAFETY & SECURITY

Each space is rented to an individual tenant.  If you are sharing the space with one or more individuals, each additional person must be declared to TSRS and provide a copy of a valid state or federal ID, and sign a house rules agreement to gain access to the facility. Tenant is liable for any actions, damages, or injuries caused by the individuals they share their space with, and any guests they bring on site, and will be held financially liable for them. Full payment for damages by tenant, authorized users or guests invited to the studio, will be made within one month of the damage. 

Guests not previously authorized must be accompanied while on the premises by tenant or an authorized person. Tenant agrees to assume responsibility for injury to and damages caused by any guests they invite to the space, including but not limited to students, performers, collaborators, guests or audience members.  

For security purposes, each authorized person will be given a door code. Door codes cannot be shared. This allows TSRS to remove access as needed. 

If tenant is renting a room, they will be provided with a deadbolt key. Copies can be made for authorized persons by tenant if needed, but may not be shared with unauthorized users. Tenant may not change out the deadbolt. Keys must be returned upon move out. 

Concerns about security should be brought to management’s attention immediately.

GENERAL RULES

• Tenant agrees to rent the space as is.  No further modifications will be made by TSRS.  Tenant may make cosmetic changes to the room with pre-approval from TSRS.  Tenant improvements will become TSRS property upon tenant’s departure.
• TSRS management may enter the space, at any time, for any reason. 
• Tenant and authorized users assume responsibility for the security of the space during their rental period. They agree to keep doors locked during their rental period. Tenant and authorized users will return the space to a secure state upon leaving by ensuring everyone has left the premises, and all doors are locked.
• TSRS property may not be used for lodging or sleeping quarters in any manner.
• No open flames, or space heaters of any kind are allowed in the facility (candles, incense, sage, etc.). 
• No flammable or combustible liquids or materials, compressed gasses, explosives, ammunition, fireworks, paint/flammable materials, or LP gas may be stored or disposed of at TSRS.
• TSRS is a non-smoking facility as required by Denton city ordinance, this includes e-cigarettes, vaping, electronic vaping devices, smoking and tobacco products.
• TSRS is a drug and alcohol free facility. We will be happy to recommend a great location nearby to enjoy your favorite beverage.
• Tenants may not carry or store weapons on TSRS property. 
• Tenants may not fight, party, conduct criminal acts, or cause a nuisance on TSRS property.
• Tenant agrees to keep their space clean, and to return it to the state they found it upon arrival before they leave.  All lights and equipment should be turned off before leaving the facility.  Tenant also agrees to help keep the shared spaces in the facility clean and orderly.  If you use it, put it back. If you drop it, pick it up. If you spill it, clean it up, etc. 
• Food and drink may be consumed, but cannot be stored at the facility and food trash must disposed of immediately.
• Tenant will not enter another tenant’s space without permission, and may not touch, modify,  or use another tenant’s materials, instruments, supplies, art, equipment, etc. without permission.
• Tenants and guests may park in front of the facility or in the dirt lot next door (south) of the facility.
• Cancellations of the daily space must be made at least 2 weeks in advance or tenant will still be responsible for payment.
• For any urgent issues that might compromise the safety or function of the studio or the building, please call the facility’s emergency contact Eric Foster at 940-441-3117.  For accidents, health crises, criminal activities or fire, call 911 immediately.

WAIVER AND RELEASE

In the event of force majeure (including but not limited to maritime peril, strike, explosion, natural disaster, act by a public enemy, fire, flood, accident, war, riot, insurgence, or any other similar event), TSRS will not be liable for any damages or injuries caused by the force majeure. 

Tenant is highly encouraged to obtain renter’s insurance to cover any damages, loss, or injuries, they may incur to their equipment or guests while on site.

TSRS reserves the right to evict a tenant for violating any of the above. In case of eviction, any deposit or rent paid by the tenant will be forfeited by the tenant. Tenant will be responsible for any damages to the facility.

All of the above are hereby agreed upon, and it is agreed that tenant and authorized persons shall release, indemnify, keep and save harmless Top Secret Rehearsal Studios, LLC, its officers, employees, agents or members, and the building owners and property management, from any and all liability or responsibility for any and all damages or injury of any kind or nature whatsoever to all persons, whether agents or employees of the tenant or persons attending events for which the premises have been leased, and to all property damage proximately caused by, resulting from, incident to, occuring in connection with, arising out of, the use by the tenant of the premises. 

The provisions of this section shall include any and all losses, damages, injuries, decrees, settlements, awards, judgments, fines, claims, penalties, costs and expenses, including reasonable attorney’s fees. 

Tenant acknowledges that they have read the above rules, understand them completely, and intend to abide by them at all times. TSRS also reserves the right to update these rules at any time and will notify tenant should they be updated.
